Terms of Service

Effective date: January 1, 2026 · ExitUs LLC

By using ExitUs, you agree to these terms. Please read them carefully — they contain important information about your rights and responsibilities.

The service

ExitUs provides a secure digital vault for storing end-of-life documents and designating trusted individuals to access them. The service is intended for adults (18+) who wish to organize their estate, medical directives, and personal communications for the benefit of their family and designated contacts.

Your account

You are responsible for maintaining the confidentiality of your password and recovery codes. ExitUs uses zero-knowledge encryption — we cannot recover your password or decrypt your documents. If you lose your password and all recovery codes, your documents cannot be recovered. Keep your recovery codes in a safe, separate location.

Acceptable use

You may only store documents that you have the legal right to store. You may not use ExitUs to store illegal material, infringe on third-party intellectual property, or circumvent any legal obligations. You may not attempt to reverse-engineer, access others' vaults, or disrupt the service.

Trigger events

The trigger event system is designed as a good-faith mechanism for family access. ExitUs reviews uploaded verification documents (death certificates, medical documentation) to the best of its ability but is not a legal authority. We are not responsible for legal disputes arising from vault access or the contents of stored documents. We strongly recommend maintaining paper copies of critical legal documents with a licensed attorney.

Subscriptions and billing

Subscriptions are billed monthly or annually and renew automatically. You may cancel at any time from your account settings — cancellation takes effect at the end of your current billing period. We offer a 7-day free trial for new accounts; you will not be charged if you cancel before the trial ends. Refunds are not provided for partial billing periods.

Data and termination

Upon account termination or cancellation, your data is retained for 30 days during which you may download it. After that period, all data is permanently deleted. ExitUs reserves the right to terminate accounts that violate these terms. If we terminate your account without cause, we will provide 30 days' notice and a prorated refund.

Limitation of liability

ExitUs is provided "as is." We are not liable for consequential, indirect, or incidental damages arising from use of the service, including but not limited to loss of data, loss of access to documents during a family emergency, or disputes arising from vault contents. Our total liability for any claim is limited to the amount you paid in the 12 months preceding the claim.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law provisions. Any disputes will be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court for matters within its jurisdiction.

Changes to these terms

We will notify you by email at least 30 days before material changes take effect. Your continued use of the service after that date constitutes acceptance. If you do not agree to the updated terms, you may cancel your account before the effective date and receive a prorated refund.
